Theft vs Copyright infringement is all semantics anyway. Like you said, if the software is for sale and you take it and use it without paying, it's wrong, regardless of what you call it. I don't think anyone would flatly come out and say that a developer doesn't deserve to be paid for his/her work. Yet when you use software without paying for it, you are depriving the developer of his income.
