Would a loser pays system do anything to reduce this sort of behavior? Or is that only applied to civil cases? Am not a lawyer obviously, so please forgive the uninformed question.
- lmm 14y agoLoser pays would likely be better for the rich, but even worse for the poor - if you're a poor murder suspect or drug user being pressured to accept a plea bargain rather than risk a much longer sentence, adding in the costs of the fancy prosecution case makes it that much worse.
