ICE takes back into custody man released for violation of rights
- pcf 9mo ago[flagged]
- willmarch 9mo agoI think it is relevant to HN users that the US is falling into authoritarianism with seemingly no guardrails to prevent it.
- willmarch 9mo ago‘“We were there for a check-in and the original officer said, ‘This looks good, I’ll be right back,’” Prokosch said. “And then there was a lot of chaos, and about five officers came out and then they said, ‘We’re going to be taking him back into custody.’ I was like, ‘Really, you want to do this again?’”’
- SilverElfin 9mo agoSo the judge ruled the original detention unconstitutional, and then they asked him to “check in” as a deceptive ruse to detain him again? The idea being this time it is constitutional?
- willmarch 9mo agoCorrect.
- breakingrules3 9mo ago[dead]
- treetalker 9mo agoIn my view, no immunity attaches to a "law enforcement" officer's knowing violation of the letter or the spirit of court orders.
- willmarch 9mo agoFully agreed. This is a violation of the spirit of the law and will make everyone view law enforcement agents as untrustworthy protectors of our Constitution.
- SilverElfin 9mo agoBut who holds them accountable? The DOJ right? Is that who can pursue a case against government officials violating constitutional rights? If so, it’s not enough. We need a rethink of checks and balances. This was clear even after the first Trump administration but we’re well past that now, and in this first year the second Trump administration has conducted a lot more violations.

- cdrnsf 9mo agoThe DOJ under this administration will abet these violations. Every department that would normally serve as a check is now headed by a feckless loyalist.
- kccoder 9mo agoSadly, it seems clear at this point it is going to fall to the citizens of these states united to hold them to account.
- SilverElfin 9mo agoI sort of feel like they will keep doing things repeatedly to make it seem normal and get their base to support it. As long as they stay “ahead” of the people that way, is there real hope that citizens can hold them to account? My only idea here, which I see more people talking about, is making a general strike happen in all the major cities.
- cdrnsf 9mo agoThey're going to continue abusing people, injuring them, killing them and violating their rights because there's no accountability. The administration endorses this behavior. Dissolve ICE, dissolve DHS, impeach Noem and prosecute and or bar every single ERO agent from future public service.
- pstuart 9mo agoThe promise made was that they were going after "bad people", e.g., murderers, rapists, etc. I don't think many people have a problem with that. But that's not who they're going after, it's everybody, with a focus on ethnic cleansing. It is no longer hyperbole to compare what's happening now to Germany in the 1930's.
- cdrnsf 9mo agoAgreed. They've made it quite clear that they intend to label any dissent or protest as terrorism and use force to suppress it. I don't see how the situation will improve. Perhaps if the 3.5% rule holds true https://en.wikipedia.org/wiki/3.5%25_rule https://en.wikipedia.org/wiki/3.5%25_rule
- dpedu 9mo agoThe promise that was made was to go after the type of people you described - first. Not to stop after them. https://www.bbc.com/news/articles/cgrnn8zxdego https://www.bbc.com/news/articles/cgrnn8zxdego
- SilverElfin 9mo ago> But that's not who they're going after, it's everybody, with a focus on ethnic cleansing. This is not yet something most Americans have caught onto. The DHS made a tweet fantasizing about deporting 100 million Americans (https://www.huffpost.com/entry/dhs-100-million-deportations-post_n_6955e15ee4b0ed8017e05656 https://www.huffpost.com/entry/dhs-100-million-deportations-...) - which is roughly what deporting all non white people would look like. And Elon Musk posts white supremacist content daily - and I mean this literally. For example he called for “white solidarity” (https://people.com/elon-musk-shares-startling-post-endorsing-white-solidarity-11881885 https://people.com/elon-musk-shares-startling-post-endorsing...) and has also repeatedly called for remigration which is literally defined as “ethnic cleansing” (https://en.wikipedia.org/wiki/Remigration https://en.wikipedia.org/wiki/Remigration).
- sarky-litso 9mo agoits hard to see how the United States recovers from this administration
- SilverElfin 9mo agoGiven the administration is openly talking about not having elections, I am not sure it can. I am guessing all this chatter about the insurrection act is itself a cover to not have midterms. Will that be enough to spark mass protests and general strikes? I am not sure. I genuinely think the ability for massively violating acts to be normalized quickly is unprecedented. Anything is possible.
- spwa4 9mo agoThere must be a serious bombshell in those Epstein files if he's doing this to prevent release (anyone else notice it's all paused - again) ?
- lawn 9mo agoI saw an article about a witness to a snuff film, and he implicated Trump. Or that Trump was present when a newborn was thrown out of a boat (Trump's "post birth abortion"). It's pretty bad already.
- cdrnsf 9mo agoI do not think it will. The Democratic Party is not an opposition party in its current form. The GOP will likely hold on to power in a fashion consistent with historical authoritarian takeovers.

- cdrnsf 9mo agoThis being flagged feels consistent with the attitudes of Silicon Valley and tech leadership generally.
- spwa4 9mo agoThis is guaranteed to blow up international trade with the US and one thing is for damn sure - that will silicon valley suffer enormously. It does not make sense.
- pepperball 9mo agoIt does make sense if they position themselves to take hard power. That’s worth a lot more than money alone and worth losing even large amounts for.
- cdrnsf 9mo agoI agree. The US is fast becoming an international pariah. Every policy implemented by this administration is regressive, ill-advised and/or cruel.
- kccoder 9mo agoThe GF and I have had multiple conversations about how all these seemingly intelligent people don't: 1) care about anybody else; 2) realize that this too will negatively affect their lives; and I've come to the conclusion that these people are devoid of empathy, and they are narcissists who view themselves as being too important and powerful to be messed with. They'd never do that to me! That would never happen to me!
- spwa4 9mo agoI don't agree. They're not stupid and they're out to give advantages to themselves. More money, more power, more ... and these actions, especially if justified like you do, will absolutely fail at that. If the US as a whole becomes poorer, being a billionaire will mean a lot less. I mean I agree they're lacking in empathy, right. But this is not a cartoon. Lacking in empathy is not a goal in itself for these people. It's just not.
- marysminefnuf 9mo agoWhy do people flag anything related to ice coverage? Ice are literal nazis cracking down on dissent, dont support the administration. You gain nothing for fighting their battles online.
- willmarch 9mo agoIt’s absolutely an effort to suppress criticism and/or try to deny the now undeniable by some HN users
- timeon 9mo ago[flagged]
- SauntSolaire 9mo agoBecause the people who comment in these threads tend to be mind-killed by politics, and it serves very little purpose to have a threads full of such opinions.
- willmarch 9mo agoSo basically you’re trying to suppress opinions you don’t like or agree with, relevant or not?
- SauntSolaire 9mo agoHas nothing to do with me agreeing with them or not, they just tend to be low quality/value in general - more noise than signal on all sides.
- willmarch 9mo agoI’ve been able to have some quality discussions around these issues but I get your perspective. I hope at some point soon, we as a country, can go back to viewing politics as a rational and civil discussion of differences in policy approaches rather than as a tribal team sport or as an excuse to push extremist positions.

- josefritzishere 9mo agoAnyone want to guess what the end game of lawless secret police is? Because I know what happened last time.
- goatlover 9mo agoI keep telling myself America isn't 1930s Germany, that the guardrails of this democracy will hold, and if they don't, enough of the people will rise up and put a stop to this. That the military won't go along with firing on it's own citizens when and if given that order. That there is some sort of line even for Republicans and the Pentagon that can't be crossed without the current regime will be removed one way or another.
- lawn 9mo agoYou mean last time in Russia or in Germany or somewhere else?
- duxup 9mo agoReports today of lawyers trying to see their clients in Minneapolis are being told they can't until their clients arrive at a detention center ... that might be as far as Texas. They also couldn't even tell them if their client was still in MN or elsewhere. It's all just a bunch of illegal garbage. The courts have to handle each case and plod around, while ICE as a whole operates without consequence ... except to the people they target. It's a clear pattern of practice at this point, but I'm not sure if the courts are brave enough to act.
