And Apple has had lost a few IP fights in its years. I'm confident to say Apple and its army of lawyers will be doing just fine in America's insane patent system. So the answer is no, I do not think Apple is incompetent enough to have to pay triple damages on every patent claim they actually infringe or do not infringe.
