Both things are happening. One of the bigger grey areas are people in the process of adjudicating asylum requests. The cases aren’t finalized, and in many circumstances they are grabbing people as they leave their hearings. They are also targeting other people with visas for violations both significant and trivial. Trivial meaning misspellings or typos on one of the dozens or hundreds of forms filled out at some point in the past. Rule of law is being undermined, basically under the guise of whatever state of emergency is in place, they look to act quickly where any ambiguity exists and before courts get to weigh in.
