Interesting paragraph from dissenting opinion:
"No right is safe in the new legal regime the court creates. Today, the threat is to birthright citizenship. Tomorrow, a different administration may try to seize firearms from law-abiding citizens or prevent people of certain faiths from gathering to worship. The majority holds that, absent cumbersome class-action litigation, courts cannot completely enjoin even such plainly unlawful policies unless doing so is necessary to afford the formal parties complete relief. That holding renders constitutional guarantees meaningful in name only for any individuals who are not parties to a lawsuit. Because I will not be complicit in so grave an attack on our system of law, I dissent."

- scarface_74 1y agoThe President is literally taking away citizenship. What can be more fundamental than that?

- esseph 1y agoHold up. If you're born here And I'm born here .... ?????????? It's right there in the fucking Constitution!
- EasyMark 1y agoThat's what I'm saying, it's one of the most simple Amendments in terms of understandability, yet people will completely ignore that somehow. If the 14th can be loop-holed, we might as well chuck all copies of the constitution in the Potomac and just declare Trump dictator
- ljsprague 1y ago"Subject to the jurisdiction thereof" was added for a reason.
- peddling-brink 1y ago“Give me your tired, your poor, your huddled masses yearning to breathe free.”
- FirmwareBurner 1y agoIt didn't say "give them state paid welfare and healthcare"
- lurking_swe 1y agoit seems like you’re not really understanding the “point” of the United States and what makes it different from other countries. That’s a shame. Is america only for the white descendants, the former slave owning class? Perhaps former Nazis who fled Germany after the war? Who is america _really_ for? Why should Trump and the GOP get to decide who the undesirables are? This narrative of “giving away citizenship” quite literally makes zero sense. Even as a child growing up it was clear to me (from teachers, textbooks, books, movies) that what makes america special is its ability to integrate immigrants from various backgrounds into 1 working nation. It’s a land of immigrants from the start. The founding fathers didn’t “belong” here either. The land was stolen from native americans and other tribes that lived here. It’s in the DNA of the country. Some Americans need a big mirror and a heaping spoon of empathy IMO.

- lurking_swe 1y agowell, i’ve discussed this topic with my family that lives in europe every year when i visit, and they don’t disagree. Our immigrant culture in the U.S. is what makes us different. We don’t have a single ethnicity, a single culture, etc. the way most countries on the globe do. I also think it’s hilarious when americans, who are (almost always) americans because one of their ancestors immigrated to the U.S., try to “pull the ladder up behind them” by hating on immigrants or treating them poorly. Letting others seek a better life like their ancestors did? Inconceivable apparently…hence my comment about most americans needing a mirror. Enough about me. Since you disagree, what do YOU think the point of the US is? What makes us unique and mostly successful as a nation? Since you claim i read propaganda.

- speakfreely 1y agoIronically the largest number of immigrants have been Latinos, who come from a fairly traditional and conservative culture. Ask any Mexican outside of the capital how they feel about abortion or trans women using women's bathrooms. These are not destined to be voters for the Democrats in the long term.

- nrb 1y agoPer the policy directive of https://www.whitehouse.gov/presidential-actions/2025/01/protecting-the-meaning-and-value-of-american-citizenship/ https://www.whitehouse.gov/presidential-actions/2025/01/prot... citizenship has been taken away from anyone born from parents of targeted classes as of Jan 20, 2025 with a 30-day order for all executive departments and agencies to enact the policy.
- FirmwareBurner 1y agoWhat you say and what the link says are completely different things. Nice emotional manipulation on your end referring to illegal immigrants as "targeted classes". Maybe don't break the law and immigrate legally.
- nrb 1y agoI welcome you to point out the discrepancies if I am mistaken. Targeted classes is a common term in the context of regulations where certain bodies receive a change in protections or restrictions. This executive order is trying to overrule a law with a policy so it felt appropriate. No manipulation was intended by using a technical term.
- laughing_man 1y agoBirthright citizenship was never enacted into law. It was a policy change by the State Department early in the 20th century. Since Trump controls the State Dept, has the power to make the change - Congress needs to deal with this.
- tzs 1y agoIt's been enacted into law at least 3 times, for difference classes of people. 1. The 14th Amendment to the Constitution, which covers everyone born here who is not the child of foreign diplomats or members of foreign armed forces stationed in the US. 2. The Indian Citizenship Act of 1924 which extended it to Native Americans who were living under tribal sovereignty. 3. The Immigration and Nationality Technical Corrections Act of 1994 extended it to children of US citizens who are born outside the US.
- laughing_man 1y agoWell, okay, but none of this applies to the children of illegal immigrants.
- tzs 1y agoMost illegal immigrants are not foreign diplomats or members of foreign armed forces stationed in the US.
- fzeroracer 1y agoIf you believe illegal immigrants can commit crimes, be jailed and be deported then by definition they are subject to US jurisdiction. There is literally no other position to hold here outside of outright hypocrisy.
- const_cast 1y agoYes, yes it does. Explicitly and without debate.
