- kelseyfrog 2y agoWould this not involve overriding TRUMP v. UNITED STATES[1]? > Held: Under our constitutional structure of separated powers, the nature of Presidential power entitles a former President to absolute immunity from criminal prosecution for actions within his conclusive and preclusive constitutional authority. And he is entitled to at least presumptive immunity from prosecution for all his official acts. There is no immunity for unofficial acts. 1. https://www.supremecourt.gov/opinions/23pdf/23-939_e2pg.pdf https://www.supremecourt.gov/opinions/23pdf/23-939_e2pg.pdf
- howard941 2y agoNo, it's not a criminal prosecution.
- kelseyfrog 2y agoIf it's civil the President has a much longer history of being immune.
- howard941 2y agoIn that event the case you cited isn't involved.
