If I had the choice in ISPs that I do in restaurants then I would accept their argument because nearly every community has a buffet. Also I don't know any restaurant where I can sit down at the table and food just starts landing at my table and I have to push it off. But every ISP works this way. You connect and trash starts suddenly flooding to you until you block it but if they're measuring your Data on their side and not on your side as far as their concerned you ate it.
Additionally I've never seen a compelling defensible argument for their data caps either. If they made the argument that the data cap only affects the top 1-2% highest usage users they should have independent data that can confirm this and also be audited. Once they start doing that they'll simply start excluding that user base from their metrics because they've "moved them to another tier". So that metric will constantly be lowered, which would also be inappropriate as it's manipulating the user base to suit their needs.
ISPs do have a legitimate concern they are a business that needs to make a profit in order to continue to provide service but the way they've acted especially the way most cable providers have acted is extremely hostile to their customers. So why would anyone give them sympathy when they are actively hostile to their customer base and that customer base remains because largely they have very little choice.
