The author is referencing a court ruling: "The Alabama Supreme Court ruled [in Feb 2024] that frozen embryos are human beings and those who destroy them can be held liable for wrongful death" thereby putting IVF clinics in jeopardy. (That particular problem was later fixed by the legislature.)
