Assuming this is true: "Apple’s lawyers said that, and also said that they didn’t want De Rosa to stop posting; “we’d rather talk through the nuances of the issue and ideally find a reasonable solution that works for everyone.”" That sounds like behaviour which should be encouraged. By which I mean, don't come in guns-blazing because someone does something which comes close to infringing on your copyright/trade-mark and try to shut-them-down. Have an appreciation of the subtleties and try to agree a good solution for everyone.
