I think Youtube is a better example than AI because AI is arguably transformative, while early Youtube had much more blatant copyright violations. It's too risky for established players to do this because they'll be sued immediately. A small player can fly under the radar for long enough to see if the idea has legs. If it does, it'll be worth it for rights holders to negotiate.
