In a lot of cases that's as much time as they'd get even if they were convicted of the crimes they were accused of. The US is never gonna let KSM go, and I can't see why he'd change his mind to plead guilty after all this time. But it seems possible that he'd agree to plead guilty, and go to a conventional American (military) prison, in exchange for sending everybody else home. That would be just, or as just as we're gonna get. And given the proximity to the election it's awfully tempting to think it would be announced soon. But it strikes me as an election-losing tactic. Despite the manifest injustice of holding people without trial for decades, the administration's opponents are perfectly happy with that, and will call it a concession to terrorists. And the people calling for Guantanamo to be closed aren't going to give them a whole lot of credit for finally solving it.
