If you try to incapacitate someone by shooting them, they will either die anyway or kill someone (perhaps you, or someone you are supposed to be protecting, or another bystander) before you can take the shot. If you had a science fictional gun that would only ever knock someone out no matter where or how often they were hit, then sure, you could go for it.
