Judges make absurd and abusive rulings all the time though too. It seems to just be a shift from a 3-letter agency to a random person who is even less accountable and certainly not knowledgeable about any particular area outside of the interpretation of the law, generally speaking.
As more power and authority moves to the judiciary and away from Congress, we’ll have more politically appointed judges installed specifically to issue rulings on cases to circumvent congress or its delegated agencies to enact legislation. I’m not sure why we think that fishermen being forced to pay for the government inspectors is any less likely to happen under this new system. A judge can just issue the same ruling based on their interpretation. Maybe it’s easier to impeach or recall a judge. Idk. It seems like a bad idea to turn the judiciary into a political football with all the instability and inefficiency that will cause.
Like so many things it’s like people have forgotten we have things pretty good and we shouldn’t change them without really good reason. A bit of a conservative idea there I know, but law and public policy don’t benefit from disruption like technology and business tend to.
But I’m open-minded here. I’d genuinely love to hear others thoughts and initial reactions to this. This was mine.
