It might not be a trademark violation, but that doesn’t mean it’s a good idea. There are other legal avenues McDonald’s could use. The absence of a registered TM doesn’t mean you can’t do anything about someone blatantly passing off [0] their product as yours (or as being officially associated with you), for example. I’m not a lawyer but I doubt you’d have a quiet life if you called your restaurant Big Mac.
