Someone in the comment section had the same answer, and the author responded "I don't know."
The complaint reads:
[Because] Musk perpetrated this fraud to enrich his revocable trust, both defendants “Elon Musk Revocable Trust dated July 22, 2003,” and his family office, Excession, LLC, are liable too.
Still not a lawyer, but that seems thin to me. Why don't we sue all executives and all of their trusts and family offices whenever there's an instance of securities fraud?
- Zigurd 2y agoIANAL but it seems like a lot of misleading statements were made by Elon outside (or at least plausibly outside) his role as a Tesla executive. For example, Tesla never officially stated many of Elon's wild claims about autonomy, range, etc. Had Tesla put such statements in a press release or product brochure, then Tesla would be on the hook.
- cchance 2y agoEPA mileage calculation being shitty, isn't teslas fault, or Elons, suing for the EPA mileage not matching user expectations. He's said some false shit and over exaggerated endless things, but the mileage really isn't the thing i'd be suing over.
