The legislative and executive branches have always wanted that type of drawn child porn to be illegal. Going by the laws on the books, it still is. The only reason it is not illegal is the supreme court ruling such laws unconstitutional under the first amendment. Deepfakes are sufficiently novel, that the old precedent does not completely apply, so the executive is free to enforce the law until the appeals courts start ruling to the contrary. And with the current make up of the Supreme Court, I'm not sure which was the constitution will end up going on this issue.
