The question is whether these bodies were those of grown adults engaged in consensual activities. The answer is, in all likelihood, no. Many folks trying to give him the benefit of the doubt here, not sure why he deserves it (given he’s a repeat offender too).
- James_K 2y agoI don't think people are trying to give him the benefit of the doubt as much as this story is misleading. It only really makes sense if the pictures are of adults because if it was child porn it wouldn't be a news story. "Man goes to jail for having edited CP" isn't newsworthy in the same way as "man goes to jail for having AI generated CP". People's bias here is to just assume that they are being told something interesting because otherwise there is no reason to share this information.
- basil-rash 2y agoThis isn’t a news story as much as a DOJ press release, of which there are many many thousands available. News agencies have picked it up to get clicks, that doesn’t make the guy less guilty. News agencies do the same when a mass murder goes to jail, should we assume that is unexpected too? Anyways, I’m not interested in playing this game of “defend the pedo”, but this site has way more background on the case: https://casetext.com/case/united-states-v-smelko-2 https://casetext.com/case/united-states-v-smelko-2 But I was actually incorrect, child faces on adult bodies is still unlawful, the linked article goes into more detail and prior casework on the matter.
