ToS should be considered in antitrust as well. In a world where antitrust was enforced we'd hear arguments like "this is a 100 billion dollar industry, but there are zero companies that allow customers to keep their <freedom / right to sue / right to keep data private / etc>". When an entire industry adopts the same ToS and customers are unhappy about it, clearly there is a lack of healthy competition.
