Food is allowed to be labeled at Paleo Friendly and Keto Compliant, so why not "Low FODMAP"? I do think the title is clickbait though. I guess "Customer Sues USDA to allow Low FODMAP foods to be labeled as such" doesn't quite have the same zest to it.
