As is, the bill is not fair to small players. It encourages ventures to use existing models by big players to escape the regulatory burden of "safety", leading to a state-encouraged oligopoly. It also uses compute and benchmarks as the measuring stick for regulation, which can be easily gamed - and already is being gamed. Instead, the application plugged into the AI needs to be regulated. Does the application run afoul of the safety goals of the bill? Then restrict the application, not the model itself.
