I wonder if this is a consequence of the judicial system in the US. In Europe there is something called promesse de porte-fort (contract at the expense of third parties) as Microsoft is not party in the licence agreement I would say. Some effects of the GPL ( or rather interpretations) are just plain ineffective. I say this while not questioning the copy left in general.
