Federal Court: Canada's invocation of Emergencies Act in 2022 was 'unreasonable'
- barbazoo 3y ago> Off-Topic: Most stories about politics, or crime, or sports, or celebrities, unless they're evidence of some interesting new phenomenon. Videos of pratfalls or disasters, or cute animal pictures. If they'd cover it on TV news, it's probably off-topic. https://news.ycombinator.com/newsguidelines.html https://news.ycombinator.com/newsguidelines.html
- cempaka 3y agoThis subject was on-topic enough to warrant a thread with over 1,000 comments when the Emergencies Act was invoked, much of which centered on whether the government's use of these special powers was justified.
- barbazoo 3y agoIt was probably off-topic back then too I assume.
- cempaka 3y agoHere's where you weighed in at the time: https://news.ycombinator.com/item?id=30432611 https://news.ycombinator.com/item?id=30432611
- barbazoo 3y agoI fail to see how that's relevant here
- Mountain_Skies 3y agoLots of people cheerleading horrific abuses of their fellow human beings during the pandemic now really REALLY don't want anyone talking about what they took part in doing. They don't even want to think about what they supported. Mirrors are harsh for monsters. Best off not becoming a monster in the first place. For those who already become one, the next best thing is for them to learn why they became a monster and figure out how to not become on again. Denial isn't the path for that.

You really don't feel comfortable with this news and you want it to go away? How does it make you feel to know each protester whose rights were violated will get a big $ pay out?
- barbazoo 3y ago> But you do seem to have a foot in this. lol, actually read my comment and re-evaluate that statement :)
- incomingpain 3y agoAnd unconstitutional. There was no emergency. The emergency act was written with compensation to those whose rights were violated. https://laws-lois.justice.gc.ca/eng/acts/e-4.5/page-3.html#h-214146 https://laws-lois.justice.gc.ca/eng/acts/e-4.5/page-3.html#h... The crown will now be paying these protesters significant sums of money. >$20 millon each. There has been a bunch of charges withdrawn this week: https://www.cbc.ca/news/canada/windsor/ambassador-bridge-charges-withdrawn-1.7089065 https://www.cbc.ca/news/canada/windsor/ambassador-bridge-cha... https://calgaryherald.com/news/crime/crown-withdraws-charges-against-coutts-protester-who-hosted-others-on-her-property https://calgaryherald.com/news/crime/crown-withdraws-charges... Big federal judicial review happening in the shadows.
- barbazoo 3y ago> The crown will now be paying these protesters significant sums of money. >$20 millon each. Interesting, according to CBC > Deputy Prime Minister Chrystia Freeland told reporters at a cabinet retreat in Montreal that the government plans to appeal the decision. So I'd be surprised if they already compensate anyone at this point. https://www.cbc.ca/news/politics/emergencies-act-federal-court-1.7091891 https://www.cbc.ca/news/politics/emergencies-act-federal-cou...
- incomingpain 3y agoIt's in her power to appeal. Probably a really bad strategy for her party though. As for payouts, they would be going forward now despite an appeal, but in acknowledgement of the appeal. The emergency act had never been used before, it has to be an emergency. The act has an entire section about compensation to those whose's rights are violated. That goes forward now.
