Perhaps most of the five justices who agreed to this decision are happy with our having a porous border. But I don't think this is necessarily a politically motivated decision. After all, the federal government is responsible for controlling our national borders. Maybe the Court's next relevant decision will be along the lines of: "Executive Branch: Take seriously your responsibility to keep any and all persons from entering this country illegally. Get the job done."
- TravisCooper 3y agoYeah, this should be read that the Federal Govt has to have access to national borders, full stop (agreed). It doesn't (and can't) address the fact that the reason the Federal Govt wants access in this case is to help non-nationals BREAK FEDERAL LAW.
