I am kind of surprised by this because afaik, selling tickets in secondary sites is exactly what artists (well their management companies) actually do. Katy Perry famously revealed this about a decade ago in a court documents - her contract showed X% of tickets to be available to her for resale on secondary markets. So it seems a bit rich to prosecute for that - and frankly it would be my go to defence at trial
