It does not matter if training models is not the same as reproducing something exactly if we wish to decide that it's unfair or even just desirable for economic incentive to disallow it, then we are free to make that decision. The trade offs are fairly profound in both directions I think and likely some compromise will need to be made that is fair to all parties and does not cripple economic and social progress.
