  Not saying that, but some of those reasons for passing on a candidate are straight-up illegal.

    Illegal if you do it explicitly. Legal if you do it by proxy criteria and plausible deniability.

        Schrödinger’s cat. It’s not illegal till the court looks at your situation and says it is. Companies do plausibly illegal things all day long.
