Let's imagine that they settle out of court. And then in a few years, as AI improves, the NYT relies on AI to write some of their articles (or they rely on AI to proofread and edit their articles). Can the Times' current arguments be used against them using AI later?

I don’t see how. If they own the content (which in the outlined scenario they would) they could do whatever they want with it. The argument is about unauthorized use of copyrighted materials, not just using AI in general.
