It's a seemingly never-ending scandal that in the United States the remedy for infringing on workers' rights to take collective action is a notice posting ("[management] won't infringe on your rights again") or a make-whole order ("you will get back pay and reinstatement months or years after being fired in retaliation").
Firms won't change their behavior until they face stiff financial penalties, much as they would for violating the rights of investors or other property owners. The vast majority of people live through wage work; their rights shouldn't take a back seat to those of the owning classes.
- hn1986 3y agoThis should be a clear cut case of worker retaliation. I see SpaceX/Musk losing in court unless they settle.
- jncfhnb 3y agoBack pay for years of work you didn’t do is pretty great though?
- avidiax 3y agoYour employer being properly disincentivized from illegally mistreating you would be better.
- jncfhnb 3y agoThe disincentive is that they need to pay you for work you didn’t do
- Ancalagon 3y agomost people wont get backpay in similar instances because they lacked the time, money, or evidence to take their employer to court
