Eventually the SCOTUS will have to decide if training is a form of fair use. There are plenty of arguments on both sides. The LLMs built and trained 10 years from now will be much more advanced. Will it be possible for anyone to prove if specific content was used/not used in the training? If the courts rule against fair use, it will be a minefield to enforce.
