I'm from the US and have no attachment to Scotland; if I claimed to be a Scotsman and you pointed out that I'm not, and I said "well that's just the no true Scotsman fallacy!", then I would be totally full of it. In the same way I am not a real Scotsman, your toy example of an easily specified snippet of a function that doesn't do anything useful is not real software.
