They wouldn't be violating under the terms of this agreement - they're granted a perpetual license. But unless I'm misunderstanding you I believe you're missing the point. This is pretty much written with the assumption that engineers wouldn't grant permission to a first strike action whoever it were against and that that's fine. It's turning patents into tools weapons that can only be used for retaliation.
