Wouldn't this just incentivize ODMs to intentionally stonewall development so that they can then steal the patent?

  The original patent holder, say Apple, is free to develop a product for their patent on their own.

      Yeah - if anyone needs patent protection, it’s the little guy. Perhaps there should be some restriction on the patent applications from large corporations.
