There is a difference in that case, that many models (if you believe weights can be copyrighted) are being released under non open source licenses like RAIL or Meta's custom llama licenses, but are being promoted as "open source". Historically it seems there's been more honesty about switching licenses, now we have "fauxpen source" trying to use the terminology for marketing credit, and succeeding.
