Why didn’t employees get more notice? Why wasn’t WARN Act triggered?
- adastra22 3y agoCompany shutdown != layoff.
- eli 3y agoYes it does though? The legal entity of the company still exists, it’s just no longer conducting business or paying employees. Thats a mass layoff. The California version of the WARN Act explicitly covers terminating business operations.
- adastra22 3y agoIf the company is actually shutting down (is it?) then no, the legal entity will not exist for much longer.
- paulddraper 3y agoOkay, sue them.
- benced 3y ago> A "faltering company" is not required to give notice of a layoff or plant closing when, before the plant closing, it is actively seeking capital or business, which if obtained would avoid or postpone the layoff or clo- sure, and if it reasonably believes that advance notice would hurt its ability to find the capital or business it needs to continue operating https://www.dol.gov/sites/dolgov/files/ETA/Layoff/pdfs/WorkerWARN2003.pdf https://www.dol.gov/sites/dolgov/files/ETA/Layoff/pdfs/Worke...
