It's hard to define consciousness itself. It may be something wholly apart from sentience and sapience. So it's kinda already setup to be something arbitrary.

It may very well be a case of "it's conscious if it's sufficiently indistinguishable" from human consciousness. Anywhere something is arbitrary, it's just going to be endless arguments from every "side".
