Sending a signal and waiting for a reply is communication. An agreement doesn't have to be written, or even spoken. Amazon colluded by effectively using the price as a carrier signal.
- jjk166 3y agoBut it isn't secret communication, which is the necessary requirement for collusion. An agreement doesn't have to be written or even spoken, but the FTC does have to prove that a secret agreement exists, which is really hard to do without a written or spoken record.
