Reasonable take, where I'd perhaps feel I'd disagree is that 90% of the Western World uses Google for search, mobile OS or whatnot- is it reasonable to presume they all read the ToS(s) and understand the consequences, or do they really have a choice in the matter? e.g. search engine choices wrt Google being scrutinised on a possible monopoly position.
