Doesn’t the Brady rule mean the prosecution would have to disclose the initial assessment, and the fact the police requested a change?
- wxnx 3y agoIANAL, so I genuinely can't answer that, but in this particular case I'd hope so, yes. More generally, I suspect circumstance dictates. Prosecutors' responsibilities under Brady do seem to be a topic of conversation in the context of "Big Data Policing" [1].
