OpenAI disputes authors’ claims that every ChatGPT response is a derivative work
- sharemywin 3y agoseems like a reasonable argument to make. don't know if there a strong enough legal basis because I'm not a lawyer, I don't even play one on TV.
- jqpabc123 3y agoSorry, I have to side with OpenAI here. What ChatGPT is producing is more like a Cliffs Notes summary --- and not a particularly good one in many cases. If this is a derivative work, then so is any book report produced by a student. At best, the author may be due the purchase price of one copy of the book if OpenAI can't produce a receipt. But not many actual purchasers could do the same so the burden of proof for infringement may be on the author.
- dtagames 3y agoWith a large enough corpus, any piece of writing can be said to be derivative. For example, if we take into account all known writing in English, all future writing in English is derivative.
