To Regulate Tech, Nullify Click-Through Contracts
- salawat 3y agoI've been saying this since I first encountered them. EULA's are different from conventional contracts in that there is no meeting of the minds that occurs, and no back and forth. Business would be terrified at such a move though, as they'd actually have to receive and address customer concerns. Consider: If it were legally mandated that Google had to receive and individually address a request for "I want what you're offering, minus hoovering my data", and had to send a response to satisfy the meeting pf the minds requirement, it could nullify data/surveillance subsidized business models overnight. All of a sudden, there's no wiggle room left to say one thing, but act differently. Billions of people would end up having to be told "no, we specifically built this because your data has value that we want to tap." That, even in corpo speak, creates a reputation. Suddenly, you have a company looking at you and saying "You just aren't the customer we want." Which if you ask me, changes the game enough to actually get it looking something like good faith again.
