I think there are cost maximizing lawsuits (like mesothelioma) and then lawsuits that aren’t seeking to recover damages. And they pay their expert witnesses very differently. I also think there are many academics unwilling to serve as expert witnesses for tort lawsuits and they are different from “professional” expert witnesses.
