I'm no fan of our current IP regime, but I recognize the reality of copyright law as it exists today. No reasonable interpretation of existing copyright law allows them to do what they did. In an attempt to Uber us all into a friendlier (but DRM-powered) IP regime, they've painted themselves into a corner, and now find that they "have to" make foundational compromises on their position on the free and open distribution of knowledge. I treasure the Internet Archive and I dearly hope this lawsuit doesn't ruin them. When this is over, I hope they've realized that DRM is not the answer.
