  Or maybe the developers of those games have given their assurance to Valve that they own all the relevant copyright, and therefore the same standard is being applied? > As the legal ownership of such AI-generated art is unclear, we cannot ship your game while it contains these AI-generated assets, unless you can affirmatively confirm that you own the rights to all of the IP used in the data set that trained the AI to create the assets in your game.

    If they claimed that then they lied because we all know those games studios didn't train their own Image gen models without relying on the base SD models

      Maybe they did, maybe they didn't. But if the developer is willing to sign a document saying they own the rights, that's probably good enough for Valve to feel their ass has been covered.
