- robertlagrant 3y agoFrom the guidelines[0]: > Please don't post shallow dismissals, especially of other people's work. A good critical comment teaches us something. [0] https://news.ycombinator.com/newsguidelines.html https://news.ycombinator.com/newsguidelines.html
- pjc50 3y agoOnly some places and people have the weird US "at will" condition. Others have contracts, in which people must be given notice, and failing to do so is breach of contract. Some places have legally required redundancy processes, which have not been followed. (A particular example: https://www.marketwatch.com/story/elon-musk-apologizes-to-disabled-ex-twitter-employee-who-was-voted-icelands-person-of-the-year-in-2022-ba0a3a8a https://www.marketwatch.com/story/elon-musk-apologizes-to-di... - as a senior employee of a company acquired by Twitter, he had some sort of golden handcuff contract which guaranteed him a large payment if he was ever fired)
- phpisthebest 3y agoWell given the story is from a US News Site, talking about a US law firm, about arbitration happening in the US, it seems the laws of the US are what is in play here, and in the US we do have at will employment.
- wholinator2 3y agoI keep finding conflicting information on this. It looks to me like all 50 states do have at-will employement, except when they don't. Which appears to be a long list of strange and specific exemptions. Do we know what jurisdiction these firings occurred under and whether anyone has an actual case due to these exemptions?
- ImPostingOnHN 3y agoemployment contracts override at-will employment
- dghlsakjg 3y agoYou can if there were explicit written promises made and broken. Especially if those promises were made to keep you from taking action that would otherwise be in your own interest. Courts recognize things like opportunity cost in cases like this. If you made the decision to stay with twitter instead of taking another offer because you were promised that there were no layoffs and RSUs would be honored, the courts see that as an additional harm.
- compiler-guy 3y agoIf you agreed to pay salaries consistent with salaries before the acquisition, and industry standard severance in the event of layoffs, all of which Musk did. And then don't do that, you most certainly can be sued, and you will lose.
- skulk 3y ago> Idk what actual claim they have Good thing TFA clearly states that Musk is stiffing them on their severance...
