- ggm 3y agoI am not a lawyer, but if you wanted to float "it happened by accident" then having people willing to say "oh no, there was a HUGE amount of intentionality behind what boxes went where" and "he had really good recall of what was in which box and even in what order" can't really play very well. I believe that the basis of his legal peril isn't the boxes exist: it's that after he was told, he obstructed justice by not immediately volunteering everything up. So at one remove, "he knew" is neither here nor there.
- jfengel 3y agoThe basis of his legal peril includes both, and many other things. It's such a wide basis that his hope basically has to rest on sweeping it all away at once: finding a juror willing to hang the entire thing, letting a judge dismiss things and exclude evidence, relying on a Supreme Court he appointed to side with his contention that as President he's allowed to do whatever he wants. These aren't great hopes, but he's got a talent for just barely pulling out of things. He's avoided consequences many times in the past, and he's not unjustified in thinking he can avoid them again. So it doesn't really matter what the real basis is. None of it puts him in jail by itself. That relies on a complex system of judges, lawyers, jurors, and others, any part of which can make the whole thing go away if they're minded to.
