It's more just a license that's an ad. It basically says "contact sales" and tries to anchor at 10% royalty payments.
It comes across to me as extremely sleazy. There would be lots of other ways to commercialize something without putting ads in your "license" and pretending (at least in the HF statements I've seen) you have an open source offering.
At the same time, it seems like basically pure play rent seeking - there's no cloud or some ancillary reason you'd pay, it's just "give us money for the privilege of using it". It's actually awful terms.
