Uh, what? Did anyone actually check with the other judges to see if they're okay with the most corrupt supreme court judge speaking for them?! It seems really unlikely that everyone would have just gone along with this.
- dmitrygr 3y agoThe judges discuss the case, and then, if they agree, one of the majority is chosen to write to the majority’s opinion.
- jfengel 3y agoThe chief justice names the person who writes the decision, if he's in the majority. (If he's not, the most senior justice in the majority decides who writes it.) The others don't get a say in that. However, they're permitted to write a concurring opinion if they agree with the outcome but disagree with the way it's reasoned. I have been told that all of the Supreme Court justices get along, despite ideological disagreements. I haven't heard anything about that changing since the ethics allegations; I doubt any were unaware of it. Supposedly, the job of Supreme Court is so far removed from any other position that they are a community unto themselves, because nobody else can share it. That strikes me as horseshit, but it's what multiple sources (of varying ideological outlooks) have told me.
