How is this constitutional?
- Spivak 3y agoWait for the lawsuit from the ACLU + collation to drop. It likely isn't. It's technically a secret that they're going to sue but everyone already knows at this point so it's fine.
- jfengel 3y ago"Constitutional" is what five members of the Supreme Court say it is. I'm sure they can come up with reasoning either way. I suspect most neutral observers would say it's unconstitutional. But what they think does not matter.
