I just had a thought that could potentially work against DMCA, but am admittedly not super knowledgeable so perhaps someone from HN can verify the validity of the idea.
Given certain genres of software being more prone to DMCA than others, would it be at all possible to backup these software in a non-distributable manner and potentially even hidden if required where the distribution is tied to the DMCA notice?
When the notice to Github or similar is given, the backup backs up to yet another service before opening distribution to the DMCA'd content. The backup service waits the legally allowed time to also remove this backup at which time the tertiary service goes live. Could this be used for malicious compliance against malicious actors?
